It's not a warrant. It's a Writ of Assistance, very similar, but not quite. http://definitions.uslegal.com/w/writ-of-assistance/ A normal warrant for arrest say could probably be served by any other law enforcement official, not sure how a Writ of Assistance works though. And, it would need to be in hand by whoever tries to go get Max so since it's held by the Sheriff's dept, that's who has to serve it.

It sounds as if, since the deputy failed to do it, and since he is basically supposed to be 'standing in' for the Sheriff in all matters, (we had a deputy here who screwed up and that was the gist, since the deputy was 'acting in stead' for the Sheriff himself, the Sheriff got reamed!) , I hope the judge gets seriously tweaked over the sheriff's dept failing to follow up on this. Until then it's all a moot point.
 
i've been following your thread.. i'm soooo sorry. i have just told my mom your whole story (she is a horse lover and had one when she was in high school) she is very sorry too and we both hope this gets resolved soon

I would hope that this means jail time for the nefarious uncle. He is now in violation of TWO court orders, the first (months ago) stipulating that he must feed and care for the horse and not dispose of him or transfer him to anyone until the case was decided, and the second being the order to turn him over to his rightful owner.

So, he "gave the the horse away", and refuses to disclose his location, and refuses to turn him over.

How many of us could get away with that???

Here's hoping the judge is royally PI**ED about this and will do something drastic.
