Stolen Horse--Man is BACK in jail!

I've kept silent through this whole ordeal and have just followed, but I feel compelled to throw this out there too.

If the uncle brings up monies that you owe for whatever services he supposedly has given the horse, you need to make sure that all of the time you have spent trying to retrieve this animal doesn't get pushed aside. You haven't by chance kept a log of all of the phone calls and such that you've made trying to get your horse back have you? Documentation in court is everything.

Money spent to keep stolen property is not considered, the uncle is SOL, in fact if the horse is not in top condition he can be charged with that also. When a person accepts stolen property they are out on a limb. She owes him nothing, he deserves only jail time.

Good point. The Uncle's "out" on this will likely be that he tried to contact you, couldn't, and incurred significant costs stabling your horse. Hard to sell that one to a judge, since he bought the horse ... he'd be admitting that he knew he bought a stolen horse if he then claimed he was boarding your horse while unable to contact you.

... on top of that, your agreement was with the nephew, who had no right to sell your property, but I doubt that will stop these guys from changing their story to try to get out of being prosecuted.

If you've got a good log of who you talked to and when, and which authorities you spoke with, these guys may just hang themselves trying to wiggle out of this!

I will need to go through and write in complete sentences though, otherwise it's going to be confusing...

Plus, I am going to be printing off every phone record I can for the past year so that everyone will be able to see everything I have done. I only have a cell phone, so every phone call I've ever made has been logged on the cell phone.

Be careful to do that on a separate document, so that it doesn't appear that you've doctored the evidence.

Fingers crossed for you

DON'T alter that spiral notebook. Make a separate notebook with details of each item. Or photocopy the notebook and make notes on the photocopy....THAT is altering the documents and that is not good in court.

EXACTLY! You go through and alter those notes, you will hang yourself. The judge won't put up with evidence that is being thrown at him that has been doctored. He will consider you a waste of time.

It's best if there are no pages missing, as well. Don't tear any out. If it is an 80 page notebook, it's best if it still has 80 pages in it. Not a show-stopper if it doesn't, but it's the first thing an opposing counsel is going to jump all over.
