But when you buy a home with HOA, you are signing an agreement to abide by the rules. It's a contract, and enforceable. The way out - don't buy in the first place. When we moved here from CA, it was top on our list - NO HOA, having sold one with horrible rules.
We own some rental properties, and every once in a while we get tenants who think that because they pay monthly rent they can do what they like. Not so. We have it spelled out in a contract and enforce it. Especially the rule about dogs, particularly aggressive breeds. Don't like it, go somewhere else.
I wouldn't look at any houses in an HOA. I saw how bad they were back in Virginia. You hear about even more horrid ones in the news fairly often as well.
The homeowner is well within their rights on not allowing aggressive dogs to renters as they can be held liable too.
