What I hoped would never happen has..

Ohio Revised Code:

955.28 Dog may be killed for certain acts - owner liable for damages.
(A) Subject to divisions (A)(2) and (3) of section 955.261 of the Revised Code, a dog that is chasing or approaching in a menacing fashion or apparent attitude of attack, that attempts to bite or otherwise endanger, or that kills or injures a person or a dog that chases, threatens, harasses, injures, or kills livestock, poultry, other domestic animal, or other animal, that is the property of another person, except a cat or another dog, can be killed at the time of that chasing, threatening, harassment, approaching, attempt, killing, or injury. If, in attempting to kill such a dog, a person wounds it, the person is not liable to prosecution under the penal laws that punish cruelty to animals. Nothing in this section precludes a law enforcement officer from killing a dog that attacks a police dog as defined in section 2921.321 of the Revised Code.

(B) The owner, keeper, or harborer of a dog is liable in damages for any injury, death, or loss to person or property that is caused by the dog, unless the injury, death, or loss was caused to the person or property of an individual who, at the time, was committing or attempting to commit criminal trespass or another criminal offense other than a minor misdemeanor on the property of the owner, keeper, or harborer, or was committing or attempting to commit a criminal offense other than a minor misdemeanor against any person, or was teasing, tormenting, or abusing the dog on the owner’s, keeper’s, or harborer’s property. Additionally, the owner, keeper, or harborer of a dog is liable in damages for any injury, death, or loss to person or property that is caused by the dog if the injury, death, or loss was caused to the person or property of an individual who, at the time of the injury, death, or loss, was on the property of the owner, keeper, or harborer solely for the purpose of engaging in door-to-door sales or other solicitations regardless of whether the individual was in compliance with any requirement to obtain a permit or license to engage in door-to-door sales or other solicitations established by the political subdivision in which the property of the owner, keeper, or harborer is located, provided that the person was not committing a criminal offense other than a minor misdemeanor or was not teasing, tormenting, or abusing the dog.

Yes, I am legally allowed to kill these two dogs if they come onto my property and try to attack my 'livestock'

Please do not take no for an answer from the dog warden. I'll bet he has a boss. If that is still not helpful, go to your county attorney (or whom ever prosecutes minor cases for your county) and ask them to file charges. If they ask, show them your evidence. If this still doesn't produce what you were expecting, file charges yourself in the court where traffic ticket cases are heard. There will be some way to get these people to court.

Do what you have to do; like I said before - if I was there, I'd help you...

He is failing miserably in doing his job and someone should hold him accountable in that regard. I live on 10 acres and my dog is in her fenced yard. My heart aches for you. I'm a crazy chicken lady too and proud to be one. The definition of pet on dictionary.com is any domesticated or tamed animal that is kept as a companion and cared for affectionately. Doesn't say it has to be a dog or cat or horse...chickies qualify!!!

You could always call the newspaper and tell them your story. Maybe the bad press would shame the law into doing their job.
 
your dog warden thinks a chicken isn't worth his trouble, that is a big problem for a lot of people, 'its a chicken big deal' we need to help people change that thought
 
I was so sad when I read your story. Like I posted earlier, I came very close to losing my Pearl White Leghorn to a hawk. I know how you must feel. I'm sorry.
 
I am so sorry for your unnecessary anguish. Last friday I finally broke down and called the dog catcher. Neighbors dog had killed seven of my runner ducks on five different occassions. Came home from work, the dog had pushed his way thru a 1/2 hardware cloth door. This time I got there at the right time, the dog had not killed anymore ducks. I called the sherrif, he came but couldn't catch the dog running around on my property, so he ended up following the dog home. Once it was back on the owners property he couldn't take the dog! Really? Although the catcher did take a report from me and promised me that the owner would be fined $175. It is just a matter of time before it happens again. Next time, the dog won't be on my forgiveness list. Love animals, but if the law can't take care of the problem, I can. I too am planning a long road trip, dog deserves a better owner. Most states have laws protecting livestock, don't give up and do your very best to embarrass the jackels that own the dog. If they are big shots, you can give them lots of bad press.
