Just a country girl. You have given me so much hope. My chickens have never bothered anyone. They (animal control) states that " you will be violation if they are not removed" they also tell you that they will fine you as well. I love that you made those dog owners pay for the chicken's injuries. First of all, the dog was "at large", and they should be responsible. I am going to PM you with the stupid "so called letter" the animal control dude left me, okay, then you can see how you may be able to help. Oh, I sure hope so, you would make my day and then some!!

In fact I find mine looking over my fence all the time (can we say 'Peeping Tom' Ive also caught him spraying my dog with water because my dog was barking at him because he was standing on top of the fence between our yards.

Drives me nuts. So I know he will probably complain about the chickens Im going to be getting

Let us know the outcome, Im very curious, I will be rooting for you.

Reading this , I am glad to know I am not alone on my worst fear. I too fear animal control to come make me get rid of my chickens. I only have hens, but they do make some noises when they lay and I am in the city. I spoil my pets big time and I spend hours with my chickens because of my illness. When I am with them I feel better hard to explain but they are so soothing to me. I also know in my area I am not only one who has chickens I have even heard roosters but can't tell where they are coming from. With the economy like it is I like being able to have my eggs.
I am not to sure what loop holes there are in the laws, they seem outdated to me because my 15 hens make alot less noise then anyones dogs or kids for that matter. Also I never even checked to see if I could have ducks before I got mine. But since they dont make any noise I don't see why anyone would have a issue. Laws need to be changed IMO

That's pretty creepy about your neighbor looking over your fence all the time… sounds like borderline stalking or "peeping tom" behavior. Don't know about dogs, but here if you spray another person with a hose they can charge you with assault. Chickens and dog aside, if he lived next to me and peeked over all the time at my family, I'd be calling the authorities. Maybe you can get the local deputy to take care of Mr. Nosy before you bring home any peeps- you also might want to check your ordinances regarding keeping chickens just to see how much trouble he could cause you, or keep them on the other side of your house away from him in a "stealth coop." I hate to hear about people losing their birds because of bad neighbors.

Exactly MrsSmith, the laws do need to be changed! I don't have a rooster, the one I did have, he was supposed to be a pullet, I have since found him a good home. Okay, I do understand the law if it states "no roosters" they can be noisy, and like you say, chickens only get a little noisy when they do their egg song, BIG DEAL, right? they do bring me much happiness and a good laugh or two. The eggs are just a benefit of them.
Really, chickens to me are no different then say, owning any other bird. I know that you could have a huge aviary, and they can't tell you to get rid of it. Doesn't our cities and such have better things to "chase after" then us, the little chicken owners, with our hens in the back yard?

Would it make a difference if you could go to city council and put in a request to keep birds? In my town (quite rural btw) you have the right to go before city council (which happens I believe once a month here) and put in a request to keep chickens for a variety of reasons....(i.e. food...4H...personal...I dunno...) Maybe they will appreciate being asked and revise things for you? Anything is possible...

It is creepy behavior. Im trying to be civil with him. Im being a good neighbor. I might call and see what I can do about his nosy-ness.

I know that I could have chickens (they are allowed) I just didnt know how many etc. So I looked up our city code to make sure exactly what and what I can not do.

Here is whay my city code says... Which I found under animal control. So if anyone has questions about thiers they should look it up under animal control and then go from there.

Are chickens allowed in Mesa? How about roosters?
You may have up to 10 chickens on the first one-half acre or less provided any enclosure is at least 40 feet from any neighboring residence, any coop is at least 75 feet from any other residence, it is kept sanitary and they are not allowed to run loose or create a noise disturbance. A rooster is also allowed as long as it does not violate any of the above regulations.

We can have chickens so he cant complain about that. My enclosure/pen is going to be at least 40 feet from his residence. I wont have a coop I will have a "Shelter" (LOL)

We will also clean the cage everyday from chicken poo and Im going to get fly traps for any fly problems we may have. So there will be nothing he can complain about and if he does, well... he will have a fight on his hands. Im sure he wouldnt want to appear in court to defend his position because their wouldnt be one.
