Any legal advice out there??

If you do call law enforcement don't be surprised if they don't do anything about the dogs. My parents live in TN and were told to shoot them if they were a problem. With no shelter there there isn't much they can do with stray animals.

Before I would go thru the expence of paying for there boys to be removed and possibly sued I would just get animal control to pick them up and let the people deal w/ animal control. If it keep on they may even loose the dogs. She would have animal control on her side. but, again if there is dog limit laws in your area you just might end up w/ again the govt.against you. Make sure of your laws then act. If worst come to worst haul them to a shelter a few hours away...

We have one neighbor that has been irresponsible with his dogs. Another neighbor has shot the dogs repeatedly with a pellet gun, but they still kept coming back. Legal action was the only thing that worked. If you don't want to SSS, and can't take them to a shelter, how about a rescue group? Maybe she could contact a rescue group 100 miles away and say that she found them running stray and hasn't been able to find them a suitable home. That's not totally untrue. They are stray and they are not in a suitable home. Keep in mind though that could be looked at as stealing the dogs and probably not the best solution. I would advise the neighbor in writing that the dogs are a nuisance and must be kept on their own property or legal action will be taken. Then everytime they come over take a picture and call the sheriff. The neighbor isn't going to like it. Most irresponsible dog owners get crabby when they are called out on it, but it is better to have a po'd neighbor than have Mom constantly stressed or possibly injured.

I suggest that since her dogs are confined, that she leave out a very dead animal for the neighbor's dogs to roll in. Dead skunk works well.

After a couple of unpleasant surprises, they will make sure the dogs don't go roaming again.

Tennessee does have "dogs running at large" laws. If your County Sheriff won't act on this, then call the State Police.

Dug up this info on Tennessee laws on their Website:

This link was taken from the State of Tennessee Website:

http://www.michie.com/tennessee/lpext.dll?f=templates&fn=main-h.htm&cp=tncode

After the page loads click on : TITLE 44 Animals & Animal Husbandry

After that page loads click on: Chapter 8 Fences & Confinement

After that page loads click on: Part 4 Running at Large

After that page loads click on: 44-8-408 Dogs Not Allowed At Large

From that point you can click on the related laws.

Why doesn't she take some the $ she gets from the sale of the pups to build a fence around her property to keep the neighbor dogs off her property?

Well she has goats, cows, and mini donkeys but the dogs never bother them. She has dealt with them since they were . She has even had a goat kidding and the dogs just stood and watched like they were the expectant fathers. It was cute but at the same time annoying. They were doing vertical jumps and giving out a playful bark after the babies were all born. Its just they do a complete turn around when her females are in heat. I won't even go to visit(I have 2 small boys) cause they sometimes won't let you out of the car. I have told her your suggestions and she is going to consider ALL of them. She has told her neighbor that if he didn't keep his dogs home that she was going to get someone to pick them up. She even offered to buy them a kennel and he said they were cruel and the same as chaining a dog. His response about why it was cruel was that it would cause them to be mean and "turn" on him. She also told him that if she were injured by his dogs he would have to pay medical bills. He told her that he would deny ownership and not have to pay nothing and that dogs are disposable. I have met this man and I wouldn't put anything past him. He has those signs on his property that say BEWARE OF DOGS and a homemade one that says GUNS ON PROPERTY-SHOOT FIRST ASK QUESTIONS LATER. She is afraid that if she does anything to his dogs he will do something to her animals as well.

Well because most of the money she gets is spent on the mothers medical care. She isn't into breeding them for the money. She does it to better the breed. Everyone that buys from her is screened and some people have been on a waiting list for her pups all winter cause she doesn't like having "holiday" puppies. For the simple reason that people will buy a puppy as a gift then once the new wears off they come back to her with some "problem" they are louder or smellier than they expected...yadda yadda yadda. She has a policy that if the owners can't afford to care for or just don't want their puppy she will give them a partial refund depending on the age and vet care.

Now about the fence around her property. She shouldn't have too. Her dogs and all other animals are secure in their own fences for a reason. She didn't want to put up a fence around her yard. She has decorative fencing and a beautiful yard display and doesn't want a chainlink or privacy fence. But thank you for your suggestion. The above statements are from her. I am on the phone with her and reading her the responses.

"She is afraid that if she does anything to his dogs he will do something to her animals as well."

If that's the case she might as well do as ~*Sweet Cheeks*~ suggested and crawl under a chair

Bullies and irresponsible dog owners thrive when we just crawl under the chair. Call the sheriff. Tell him what the guy said about denying ownership. He'll just get a talking to first. The officer that talks to him will see that the dog is his when it's just a warning. Then he can't deny it later.

She has a short video on her cell phone of the dogs being aggressive toward my husband. Should she show it to the sheriff? I don't know of any way to get it off her cell tho. She is calling the sheriff now because the dogs are on her porch at the moment. Not being aggressive. She is tired of being nice. These dogs are going on 3 yrs old and so she has been more than nice about them long enough.
