Someone said earlier to contact every police dept. (where you once lived, whre you are now, and the state dept) and I can't believe they wouldn't do something??? That is crazy talk. If it were me, I'd be speaking to the captain and telling him I'm calling the local paper and have them do a story on my family tragedy and how our local law enforcement does not want to help putting my family back together!!

Do you have pics of your birds??? As far as the law goes, that should be enough. Even if they were "abandoned" that would be up to the humane society to deal with not just some joe shmoe. Ask the police what laws are in place to keep people from stealing others livestock (because there are lots of them) then ask why they aren't enforcing them!!!!!!!!
 
I do believe the police may be wrong in stating this is a civil matter. Livestock have different laws than pets. This may be considered a "hangin" offense if the laws have not been updated, they have stolen livestock.

You need to research the law on livestock in that state.

You are right that this is not a civil matter. Theft is criminal in every state. Has nothing to do with whether livestock or not. Livestock has different laws in some states. But the fact is that Theft is Criminal. The breach of contract might be civil, and whatever losses you may incur because of the theft might be civil, but theft is definately criminal.

Theft by someone that you have entrusted in the state of Indiana is considered peti-larceny(I am sure I have misspelled something).​

Unbelievable! Poor thing, you must be pulling your hair out. I hope you get your birds back and that every one of the idgits involved get their comeuppance, including the law enforcement officers who aren't enforcing the law!
 
hello all-i am gonna be honest i am so drained! i know the 3 people involved want me to go away..hoping ill give up.. i wont but by the time anything is done the flock will have been killed. Something I forgot to add in my update-i thought i did but.. The flock is NOT safe. The man who has some of the birds(runs horse facility) has a dog whos already killed 9 of my birds. and yes it came from his mouth. He told me his dog killed them. Now when i spoke with the animal control officer there she said well thats an accident. i said the man who has my birds takes them in and he is called a good person saving my birds from abandonment-and i am portrayed as this horrible person who left them-which i didnt. so they go to this DO-GOODER and his dog kills some of my flock and hes not made to give them back? i feel so angry. now ok lets say he didnt know the birds were stolen-well he does NOW and he wont give them back! thats ok i guess. if i go pick up the chickens well thats stealing!! say what?? who do u turn to if u cant turn to the animal control,state police? well i contactedthe Attorney Generals office.. i gotta say this is the craziest thing Ive ever heard of i think! being a single mom of 4 boys,losing our home,starting over w/out our flock..

.. if i have to go to court all 3 will be in there and i will get Mr.for the 125.00 plus ill sue for the killed hatching eggs. 4 incubators-all eggs were fertile! and ill go for the dead chickens cost too. i am just not so sure i can do that if this is civil and im 4 hours away from where the birds are. HOW MUCH EASIER WOULD IT BE TO JUST GIVE THEM ALL BACK TO ME?!i feel like im going insane!

Don't forget to tack on pain and suffering! I'm not normally a fan of suing for emotional stress, but I think this is an exception!!!
 
Before you do anything, get all your "ducks in a row".

Provide pictures of your birds, timelines, names of persons involved, statements from any witnesses who were present during any conversations with the acused. Have everything ready to present your case to the police or for a law suit.

Of course keep copies.
 
Do you have a contract with the guy who was supposed to deliver them to you?

That SHOULD make everything very simple if you end up having to go before a magistrate or go to court....

I really really hope you get your birds back!
