I say get the media involved. Show up with friends and family in front but not directly on the property with giant signs. Protesting the treatment of the birds and the fact that he won't return them.

If he is too far away, Get with some BYC'rs and have them go over there with signs and the news.

Maybe embarassing them into it will do the trick. Nobody wants bad media attention.
C'mon BYCers. WHATAYA SAY!? LET'S GIT'ER DONE!

Did you try contacting the state department of agriculture? They might be able give you some more advice. If there is a county sheriff's department, they might have an agriculture division. Are your birds show birds? When you get them back have them banded.
 
Did you have a contract (or in writting) that this man was actually supposed to deliver them to you? I am asking because if not, he can very well say that you contacted him and told him that you were leaving them there to fend for themself, and he can say he was rescuing them. Its really his word against yours..( im not saying this is the case)

Im not sure but I think this is a cival matter. I know that in most New england states a horse theft is considered a cival matter...

Why are you trying the state police and not the local? Just curious. The media would really have a hay day with this. The best thing you could do at this point is get them involved. The person who has the chickens won't like it, but neither will the police, animal control, etc... Good luck. I really hope that you get them back.
