Is this legal? Any attorneys out there? Long rant. Update page 9.

After all this now I'm interested in what's going to happen tomorrow. Either it'll go smoothly or it won't. I can see both sides. On the one hand, she was trying to be helpful by giving a heads up, and he seemed to be mean about it. On the other hand, maybe they're short handed and he's trying to be helpful by saying that it's not a good time.

Either way, one day early is usually too late to call in extra people to work that shift, so he might not be able to do anything about it. At my work, yeah, you can try to pull in extra people that late, but there are no guarantees.

I'm about 99.99% sure that once you walk in (especially with minorities) you will NOT be turned away, but you may have a disgruntled manager, lol.

On a side note, at my work we can refuse service to anyone. We of course, have only done this in certain extreme cases. (cashier getting screamed at, etc) I don't think the threat of a long line would qualify, don't get me wrong! I'm just saying that we can.

Bluie- I'm of course on your side that it was rude to say that he didn't want your students to come in. There are always going to be those ding-bat people. We have one at my work (who is a manager) and although corporate has gotten many complaints about her, nothing ever has, or will ever be done about it. And I know you may want to, but from my experience it will not be helpful to talk about how much you will spend there. I know, I know. But talk about ethics and customer service. That will get them WAY more!

Good luck!

That is refusing service. I would go anyways and see what he does. I know how that goes. I went into my local 7 -Eleven out in Eastvale Corona. I was with my Service dog as I am disable. Although not visable however. Anyways I went in there with four kids , three of mine and one of my daughters friends. We went to get slupree's. So I walked in and was doing my thing and I was stopped. Told to leave. I said huh ? Your asking me to leave ? I was told yes leave. Your not allowed in here with your dog. I then said He is a service dog. I pointed to his vest and badge. I was then told she didn't care and I had to leave. I then told her it was against the law to make me leave. Again I was told she didn't care and to leave. I was then excorted out of the store with a store full of people looking at me. I was not allowed to make my purchases and left very very upset.

There are laws to protect us , they cant refuse service imo. I don't know what the legal status would be. I would call over the managers head and complain.

In my deal I called channel 7 news which once I told them my disabiltiy was not visable they were not longer interested... Sad huh ?
Oh two weeks after it happend they did finally call to say sorry. It was not the owner , oh no he still hasnt called. They sent me a card saying and I quote " sorry for throwing you out of our store "

Yeah along with 50.00 gift card. Which I refuse to use. We are still looking for a lawyer in my area. Also I did file a written complaint with the ADA.

preppy*hippie*chick :

As far as I can tell, he never refused or threatened to refuse service. He (rather akwardly) said it was a bad time to bring a bus and asked her if she could come an hour earlier. At this point, I don't believe that he is even aware that the group in question involves minorities.

In the past, I have had drivers of tour buses show up at off peak hours and ASK if we could take a bus. People have called to arrange a date and timeframe but no one has ever just called to say we'll be here in the middle of your lunch rush. Courtesy on both sides of the counter goes a long way.

I don't think that asking her to come at a different time shows intent to refuse service or rascism. It shows that he would like for it to go well.

He specifically said, more than once, that our business was not wanted. I certainly am not sure, but since we have been there several times I believe he may have recognized me and remembered the minority groups that I had brought before. Its true, I was on the other side of the counter during previous visits, but the kids were all served quickly and efficiently. It really didn't look to me like there was a strain of any kind. And its not like it was a packed house, there were always empty seats available. A tour bus driver has the discretion to go to any restaurant. I don't. I also don't understand why some of you think I should be more courteous. In previous visits, we just showed up. This time, I was trying to give the guy a head's up. I certainly think that is more courteous than before. Do I have to ask the owner of a fast food restaurant for permission to patronize his establishment or make an appointment?

I'm a Bus Driver, and done a MD run many times, some with notification and some with out, 20 yrs the driver, I've never been turned away no matter what time of day it was and how many people where working, or in the building. Did an Arby's run once with a trainee and a manger only, the bus had 45 kids we all got served well. Make sure your kids are on there best behavior, and prove the man WRONG. Go they might not like you there but they will not turn you away, they know each one of your kids will spend money and thats what they want. money. Also most bus compay's understand when thing need to be changed, just ask.

Thanks. I feel that if I had just gone my merry way and not bothered to give the guy a head's up, this whole thing would not be an issue. That's what I get for trying to do the right thing.

Thats funny because we've lived in a trailer park with crack head druggies for a year now and I dont' even want to THINK about how many times we've had to call about rukus, parties and noise disturbances at 1-4 AM. The first thing I say on the phone is 'non emergency noise complaint' and I'm not in jail... I've called on many other things that were not emergencies but could cause a problem/accident or things I've witnessed like drugs trade etc and still not in jail...

In this case I wouldn't think the police would do much, but the newspapers would eat this up with a spoon! let us know how it works out!

There has been much made to hear in the media lately about what is served in school cafeterias. I think running to the media with "I'm taking my students to McDonalds" could backfire. And I certainly think that anyone who has had to wait a half hour behind a bus load of whoever when they only get a half hour will not find much sympathy. You must understand that many people that have short lunch time that depend on fast food will see that showing up with a bus at peak times as rude. A person should always consider the ramifications of their actions to others. And personally the discrimination because I don't get my way is getting a little old. In no way I see the manager as discriminating, I do see an assumption was made of the manager.

I think since you made an itinerary before making plans and reservations you should call and try to work with the manager. If you cost him his job with your complaints you could find yourself the one in court.

Call corporate office and report manager. I am sure they would want to know that their manager turns away busness. With this economy that is just insane.

I'm sorry its not rude, these kids need to eat like anyone else, and have just as short a lunch period. Why do they need to wait. what if 60 people showed up at that MD's and the lines were long, crying toddlers, 5 years olds running around, mother's screaming or a bus load of well behaved teens with there orders in hand that got through the lines quick . eat and leave things neat and clean. witch one do you want to deal with?????

My students don't even know about this, so there is no "arse" bullying anybody. I happen to be white, therefore not a member of any group commonly discriminated against. I am not bullying anyone. I am sticking up for my students and making sure that they have the freedom to enter any fast food establishment that they wish. Are you worried about their freedoms or your own? I just want their long anticipated field trip day to be joyful.
