Ok so what can you see with that eye, and where else is he injured? Have you been able to see any wounds? He might be terribly worn out, is all? I’m thinking of his breathing issues.
IMO the neighbor rooster doesn’t need dispatching the neighbor needs reporting. He is not restraining a dangerous animal. Also, what’s stopping the neighbor from getting another rooster right away?

His roo in my yard! My fence he broke. My trees he cut down on my property line. I should be using a 12 gauge instead of a pellet rifle

Understandable but not the right thing to do. Is this the same guy you’ve spoken to the sheriff / constable about? How ‘bout another call to your friends there?

Also, that neighbor is not above doing something even more awful when they find out you’ve “taken care of” their rooster.

You know I use greenhouse frames with aviary netting over them, extending down to the ground. That’s the chicken’s area. Easy to move around, tie up netting, etc. Then I have electric poultry netting around further out. These could take care of keeping both this rooster, other pullets and the stray cats out of your yard.

Long term though, it would be great if you could find a better place and move. That has many more variables though.
